Our solutions integrate deep into the ecosystem of greenhouses to work seamlessly with people and existing systems. Supported by highly skilled operators, trusted by growers worldwide.

For this to be successful, it is necessary that protection of personal data and confidential information be taken as a strict precondition for the development of new services and that your privacy is guaranteed by us at all times. Blue Radix considers privacy and the proper handling of data important. Your personal data and your confidential information are therefore carefully processed and secured. When processing personal data, Blue Radix adheres to the General Data Protection Regulation (hereinafter: “GDPR”) and the G4 Data Protocol.

Blue Radix processes (personal) data. We would like to inform you clearly about this. In this privacy and data statement we provide answers to the most important questions about the processing of personal data and your confidential information by Blue Radix. 1. What is the processing of (personal) data?

Processing is: everything that can be done with personal data. For example, the collection, but also the storage, retrieval, use, connection and deletion of data from our records. This is therefore a very broad concept.

Personal data is all data that directly or indirectly says something about a natural person. For example your name and address, but also – in combination with it – your consumption data.

“Confidential Information” is non-public information, including, but not limited to, data, know-how, products, product characteristics, procedures or equipment, company information, analysis, investigations, facilities, and manufacturing and trade secrets, in whatever form. 2. Who is responsible for the processing of my (personal) data?

Blue Radix B.V. is responsible for the processing of your personal data in the performance of its services in accordance with this privacy statement. Where we refer to Blue Radix in this privacy statement, we mean Blue Radix B.V.

Blue Radix has a Privacy officer who supervises compliance with the GDPR and to whom you can also turn with questions.

3. From who does Blue radix processes the (personal) data?

We process personal data of people with whom we have, want to have or have had a customer relationship. That is, for example, personal data from:

5. What does Blue Radix process (personal) data for?

If you want to become a customer with us or if you want to purchase a new product or service, we need personal information.

We can also use the data we receive from you and record about you to make analyzes to determine whether you are eligible for a certain product.

b. To execute the agreement

If you are a customer with us, we want to provide a good service. We process your personal data to execute the agreement that we have concluded with you and to be able to deliver our services to you. We cannot provide services without using your data for this. For example, we use your name and (e-mail) address details for our records and to maintain contact with you. We also use your personal data for answering your questions and handling complaints and disputes. This also applies to the questions you ask us by e-mail or telephone. We do this in the context of (legal) evidence. This allows us to check our agreements with you at a later date. But we also need your data, for example, to make our services technically possible.

For example, if you do not pay your invoices (on time), even after we have sent you a reminder, we can transfer our claim on you for collection to a third party. This party will then receive from us your details that are required to collect the claim, such as your name, address details and the invoice in question.

Blue Radix offers part of its services through various apps. The personal data that Blue Radix processes can also be processed via these apps. The processing of personal data via the apps also falls under this privacy statement.

c. To enter into and execute agreements with suppliers and business customers

If you have contact with Blue Radix for your work, we can process your personal data. For example, to determine whether you can represent your company. Or to be able to maintain contact with the company you work for.

d. To meet legal obligations

Blue Radix may also be required by law to cooperate with a request to provide personal data of customers to competent governmental authorities, such as a supervisor, the municipality, the tax authorities or the police. The further processing of that data falls under the responsibility of those government agencies. We will only cooperate if we have determined that this request meets the legal requirements.

Because we have to comply with legal obligations, we also process your data in the context of audits.

e. For the development and improvement of our products and services

In order to serve you well, we are constantly working on the development and improvement of our products and services. In some cases we process personal data for this. We do this for quality purposes, among other things. For example if you ask a question about a product.

General visitor data is kept on the Blue Radix websites, such as the most consulted pages. The purpose of this is to optimize the websites. We can also use the data that we have recorded from you to perform analyzes. With the help of these analyzes we can, for example, optimize content and thus improve our online services.

If you visit our website and/or our Crop Controller portal, then we can link your use of our websites to the information known to us about you. We do this to improve our services to you and to show you relevant advertisements. We can also use the data for performing analyzes to put more targeted information on the sites for you. This allows Blue Radix to further improve its services and adapt it to your wishes. In addition, we combine your online surfing, search and customer behavior to make you relevant offers and recommendations online and / or offline, tailored to your preferences or interests and to optimize our campaigns. We do this on the basis of cookie techniques, techniques similar to cookies and tracking pixels.

We also use the lead generation service provided by Leadinfo B.V., Rotterdam, The Netherlands, which recognizes visits of companies to our website based on IP addresses and shows us related publicly available information, such as company names or addresses. In addition, Leadinfo places two first-party cookies for providing transparency on how our visitors use our website and the tool processes domains from provided form inputs (e.g. “leadinfo.com”) to correlate IP addresses with companies and to enhance its services.

h. For statistical and scientific purposes

We can also use the data that we have recorded about you to perform analyzes and conduct research. We can then use these analyzes for statistical and scientific purposes.

We do not collect more personal data than is necessary for the purposes stated above. If we do not save the data for those purposes, we can save the data for archive purposes. This means that the data is only used for legal proceedings or for historical, statistical or scientific purpose.

6. Does Blue Radix also process special and / or criminal personal data?

Special personal data are data on health, data on religious or philosophical beliefs, ethnic data or data on race, political views, membership of a trade union, biometric data for the unique identification of a person, genetic data and data relating to a person’s sexual behavior or sexual orientation. 7. To whom does Blue Radix provide my (personal) data?

Blue Radix can provide you with personal data and confidential information to service providers that we engage in our business operations or for the performance of our services and who process this data on our behalf. For example, Blue Radix can engage service providers for IT support. Blue Radix only provides data providers that are necessary for the service provision. 9. What are my rights?

If you send a request to Blue Radix about one of these rights, Blue Radix will respond to this within four weeks. You can submit your request by e-mail to info@blue-radix.com, quoting “Privacy”. In the request you must specify as much as possible to which personal data your request relates. You must also provide your request with your name, address and telephone number. Making a request is free of charge, unless you make unfounded or excessive requests.

Before we can meet your request, we are required by law to identify you. There are various options, for example making a copy of your identity document without copying your passport photo and the citizen service number.

Right to view your personal data

As a customer you have the right to view your personal data. This means that you can request from Blue Radix which personal data is processed about you and for what purposes that data is used.

Right to correction or deletion of your personal data

As a customer you have the right to have your personal data corrected if this data is incorrect. You can also request Blue Radix to delete your data. Blue Radix can only meet this requirement if it is not obliged to store your data or if it no longer needs the data to be able to provide services to you. If the data processing is based on permission, deletion of your data is not fully possible in all cases. In that case we will have to keep the original permission as proof that there has ever been permission.

Right to object and to restrict use

As a Blue Radix customer, you have a number of legal options to prevent further use of your data. Even if you have given permission at an earlier stage, you can object to further use of your data or withdraw your permission. You can only object free of charge to the use of your personal data if your personal data is used for purposes other than necessary for the implementation of an agreement or necessary for the fulfillment of a legal obligation. If you think that the processing of your data by Blue Radix is unlawful or if Blue Radix no longer needs your data, but you want this data not to be deleted, you can make a request to limit the processing. Your data will then be saved but will in principle not be used. The right to data transferability only applies to personal data collected on the basis of consent or based on an agreement.

In addition, it may only concern personal data provided by and related to you. Right to object to profiling

At Blue Radix, no automated decision-making based on profiling takes place if legal consequences are involved for you or if the decision affects you to a considerable extent, unless this:

is permitted under Dutch law (for example, investigating tax fraud); or
is based on your explicit permission.

If automated decision-making takes place on the basis of one of the above grounds, we will specifically inform you about this. You have the right to human intervention, but also to explain your point of view and challenge the decision. You can also object to the use of your personal data for profiling. If you specifically object to the use of your personal data for profiling with regard to direct marketing, then Blue Radix will no longer use your personal data for such purposes.

10. Are my personal and confidential data safe at Blue Radix?

Your personal data and confidential information is stored carefully and no longer than is necessary for the purpose for which it was processed. Zo leggen we in dit statement uit hoe we jouw gegevens verwerken en waarvoor we dat doen. We vertellen je hier ook wat je zelf kunt beslissen over het gebruik van je gegevens. Dit privacy en data statement geldt voor iedere dienstverlening van Blue Radix waarbij persoonsgegevens of jouw vertrouwelijke informatie worden verwerkt. Dat leggen we hieronder uit.

1. Wat is verwerken van (persoons)gegevens?

Verwerken is: alles wat er met (persoons)gegevens kan worden gedaan. Bijvoorbeeld het verzamelen, maar ook het opslaan, opvragen, gebruiken, met elkaar in verband brengen en verwijderen van gegevens uit onze administratie. Dit is dus een zeer ruim begrip.

Persoonsgegevens zijn alle gegevens die direct of indirect iets over een natuurlijk persoon zeggen. Bijvoorbeeld je naam en adres, maar ook – in combinatie daarmee – je verbruiksgegevens.

“Vertrouwelijke Informatie” is niet-openbare informatie, met inbegrip van maar niet beperkt tot gegevens, knowhow, producten, kenmerken van producten, procedures of apparatuur, bedrijfsinformatie, analyses, onderzoeken, faciliteiten en fabrieks- en handelsgeheimen, in welke vorm dan ook. In Bijlage 3 is een overzicht te vinden wat verder onder vertrouwelijke informatie wordt verstaan.

2. Wie is verantwoordelijk voor de verwerking van mijn (persoons)gegevens?

Blue Radix B.V. is verantwoordelijk voor de verwerking van je persoonsgegevens en vertrouwelijke informatie bij de uitvoering van haar dienstverlening conform dit privacy en data statement. Waar wij in dit privacy en data statement spreken over Blue Radix, bedoelen wij Blue Radix B.V.

Blue Radix heeft een Data Protection Officer (“DPO”) die toeziet op de naleving van de AVG en bij wie je ook terecht kunt met vragen.

3. Van wie verwerkt Blue Radix (persoons)gegevens?

Wij verwerken persoonsgegevens van mensen met wie wij een klantrelatie hebben, willen krijgen of hebben gehad. Dat zijn dus bijvoorbeeld persoonsgegevens van:

(ex-)klanten;
mensen die interesse tonen in onze diensten;
mensen die aan een bedrijf of organisatie verbonden zijn waar wij een klantrelatie mee hebben, willen krijgen of hebben gehad.

Als een bedrijf of organisatie een klantrelatie met Blue Radix heeft en contactgegevens van zijn medewerkers aan ons doorgeeft, is dat bedrijf of die organisatie verplicht om deze contactpersonen hierover te informeren. In dit privacy statement kunnen deze contactpersonen zien hoe wij met hun persoonsgegevens omgaan.

Wij kunnen ook persoonsgegevens verwerken van derden met wie wij geen klantrelatie hebben of hebben gehad, bijvoorbeeld om jouw en onze belangen te beschermen. Dit kunnen wij doen in het kader van fraudebestrijding.

Daarnaast ontvangt en verwerkt Blue Radix vertrouwelijke informatie van haar klanten.

4. Welke (persoons)gegevens verwerkt Blue Radix?

Blue Radix beschikt over persoonsgegevens als je deze zelf aan ons hebt verstrekt en doordat je gebruik maakt van onze diensten en/of producten. Blue Radix kan ook over deze gegevens beschikken door openbare bronnen te raadplegen en/of door het verrijken van gegevens via derden. Hier vind je een overzicht van de categorieën van persoonsgegevens die Blue Radix verwerkt.

De AVG schrijft geen bewaartermijnen voor. Hoe lang persoonsgegevens mogen worden bewaard hangt samen met het doel waarvoor deze gegevens worden verwerkt. De bewaarpolicy van Blue Radix vind je hier.

Daarnaast ontvangen en verwerken wij Vertrouwelijke Informatie van klanten alleen voor zakelijke doeleinden zoals beschreven in de Onderliggende Overeenkomsten of bij het ontwikkelen van algoritmen, modellen, diensten of soortgelijke producten / services

Dit doen wij enkel met toestemming van jou. Deze toestemming kun je ook ten alle tijden weer intrekken. Na het intrekken van de toestemming zullen we direct overgaan tot vernietiging van de data. Na afloop van het productverbeteringstraject vernietigen wij de data. Hierover zullen we je informeren.

5. Waarvoor verwerkt Blue Radix (persoons)gegevens?

Uitvoering overeenkomst tussen jou en Blue Radix

a. Om een klantrelatie met je aan te kunnen gaan en tot stand te kunnen brengen
Als je klant bij ons wilt worden of wanneer je een nieuw product of een nieuwe dienst wilt afnemen, hebben wij persoonsgegevens nodig.

De gegevens die wij van je ontvangen en over je hebben vastgelegd kunnen wij ook gebruiken om analyses te maken om te beoordelen of je in aanmerking komt voor een bepaald product.

b. Om de overeenkomst uit te kunnen voeren
Als je klant bij ons bent, willen wij je goed van dienst zijn. Voor het uitvoeren van de overeenkomst die wij met je hebben gesloten en om onze diensten aan jou te kunnen leveren, verwerken wij jouw persoonsgegevens. Wij kunnen je geen diensten leveren zonder je gegevens hiervoor te gebruiken. Zo gebruiken wij je naam en (e-mail)adresgegevens bijvoorbeeld voor onze administratie en om contact met je te onderhouden. Wij gebruiken jouw persoonsgegevens ook voor het beantwoorden van jouw vragen en de afhandeling van klachten en geschillen. Dat geldt ook voor de vragen die je ons per e-mail of telefonisch stelt. Dit doen wij onder meer in het kader van (juridische) bewijsvoering. Hierdoor kunnen we op een later moment onze afspraken met je nagaan. Maar we hebben je gegevens bijvoorbeeld ook nodig om onze dienstverlening technisch mogelijk te maken.

Als je bijvoorbeeld je facturen niet (op tijd) betaalt, ook niet nadat we je daarvoor een herinnering hebben gestuurd, kunnen we onze vordering op jou ter incasso overdragen aan een derde partij. Deze partij ontvangt van ons dan jouw gegevens die nodig zijn om de vordering te kunnen incasseren, zoals je naam, adresgegevens en de factuur waar het om gaat.

Blue Radix biedt een deel van haar dienstverlening aan via diverse apps. De persoonsgegevens die Blue Radix verwerkt, kunnen ook worden verwerkt via deze apps. Het verwerken van persoonsgegevens via de apps valt ook onder dit privacy statement.

c. Om overeenkomsten met leveranciers en zakelijke klanten aan te gaan en uit te voeren
Als je voor je werk contact hebt met Blue Radix kunnen wij je persoonsgegevens verwerken. Bijvoorbeeld om vast te kunnen stellen of je je bedrijf mag vertegenwoordigen. Of om contact te kunnen onderhouden met het bedrijf waarvoor je werkt.

d. Om wettelijke verplichtingen na te komen
Blue Radix kan ook wettelijk verplicht zijn om medewerking te verlenen aan een verzoek om persoonsgegevens van klanten te verstrekken aan bevoegde overheidsinstanties, zoals een toezichthouder, de gemeente, de Belastingdienst of aan de politie. De verdere verwerking van die gegevens valt onder de verantwoordelijkheid van die overheidsinstanties. Wij werken hier alleen aan mee als we hebben vastgesteld dat dit verzoek aan de wettelijke vereisten voldoet.

Omdat wij moeten voldoen aan wettelijke verplichtingen, verwerken wij jouw gegevens ook in het kader van accountantscontroles.

e. Voor de ontwikkeling en verbetering van onze producten en diensten
Om je goed van dienst te zijn en te blijven, werken wij voortdurend aan de ontwikkeling en verbetering van onze producten en diensten. In sommige gevallen verwerken wij hiervoor persoonsgegevens. Dat doen wij onder meer voor kwaliteitsdoeleinden. Bijvoorbeeld als je een vraag stelt over een product.

Op de websites van Blue Radix worden algemene bezoekgegevens bijgehouden, zoals de meest geraadpleegde pagina’s. Het doel hiervan is om de websites te optimaliseren. Wij kunnen de gegevens die wij van je hebben vastgelegd ook gebruiken om analyses uit te voeren. Met behulp van deze analyses kunnen wij bijvoorbeeld content optimaliseren en zo onze online dienstverlening verbeteren.

Om kwalitatief hoogwaardige producten te kunnen maken kan Blue Radix vragen om data, welke we al van je bezitten, voor andere doeleinden te gebruiken. Ook kunnen we vragen om nieuwe data die je bezit met ons te delen voor een specifiek doeleinde.

We doen dit alleen na uitdrukkelijke toestemming van jou. Je blijft altijd zelf eigenaar van de data die we voor dit doeleinde gebruiken. Bij het vragen van jouw toestemming vermelden we uitdrukkelijk voor welk doeleinde we de data willen gebruiken.

Deze toestemming kun je ook ten alle tijden weer intrekken. Na het intrekken van de toestemming zullen we direct overgaan tot vernietiging van de data. Na afloop van het productverbeteringstraject vernietigen wij de data. Hierover zullen we je informeren.

f. Voor onze bedrijfsvoering
Ten behoeve van managementinformatie en ter bepaling van onze algemene strategie en beleid.

g. Voor promotie- en marketingdoeleinden

Je persoonsgegevens worden door Blue Radix gebruikt voor promotie- en/of marketingdoeleinden. Bijvoorbeeld om je te informeren over voor jou (nieuwe) relevante producten en diensten van Blue Radix en/of activiteiten en acties die Blue Radix in samenwerking met door haar zorgvuldig geselecteerde partners organiseert. Of om beter op jouw wensen in te spelen. Dit informeren kan via e- mail, telefonisch of per post plaatsvinden. Als je deze informatie niet wenst, dan kun je je hiervoor afmelden via de afmeldmogelijkheid die in deze berichten wordt geboden. Je kunt dit ook melden bij Blue Radix via een e-mail aan info@blue-radix.com onder vermelding van ‘Privacy’.

Als u onze website en/of onze Crop Controller portal bezoekt, dan kunnen wij uw gebruik van onze websites koppelen aan de informatie die bij ons over u bekend is. Dit doen we om onze dienstverlening aan u te verbeteren en om u relevante advertenties te tonen. Ook kunnen we de gegevens gebruiken voor het uitvoeren van analyses om meer gerichte informatie voor u op de sites te zetten. Hierdoor kan Blue Radix haar dienstverlening verder verbeteren en aanpassen aan uw wensen. Daarnaast combineren wij uw online surf-, zoek- en klantgedrag om u online en/of offline relevante aanbiedingen en aanbevelingen te doen, afgestemd op uw voorkeuren of interesses en om onze campagnes te optimaliseren. Dit doen we op basis van cookietechnieken, technieken die vergelijkbaar zijn met cookies en trackingpixels.

We maken ook gebruik van de leadgeneratiedienst van Leadinfo B.V., Rotterdam, Nederland, die bezoeken van bedrijven aan onze website herkent op basis van IP-adressen en ons gerelateerde publiekelijk beschikbare informatie toont, zoals bedrijfsnamen of adressen. Daarnaast plaatst Leadinfo twee first-party cookies om inzicht te geven in hoe onze bezoekers onze website gebruiken en verwerkt de tool domeinen uit ingevulde formulieren (bijv. “leadinfo.com”) om IP-adressen met bedrijven te correleren en zijn diensten te verbeteren.

h. Voor statistische en wetenschappelijke doeleinden

We kunnen de gegevens die wij van je hebben vastgelegd ook gebruiken om analyses uit te voeren en onderzoek te doen. Deze analyses kunnen wij dan gebruiken ten behoeve van statistische en wetenschappelijke doeleinden.

Wij verzamelen niet meer persoonsgegevens dan noodzakelijk in het kader van de bovengenoemde doeleinden. Als wij de gegevens niet bewaren voor die doeleinden kunnen wij de gegevens wel bewaren voor archiefdoeleinden. Dat wil zeggen dat de gegevens alleen bij juridische procedures of voor historische, statistische of wetenschappelijke doeleinden worden gebruikt.

Op de website van Blue Radix zijn enkele links naar websites van andere partijen opgenomen. Blue Radix draagt geen verantwoordelijkheid voor de wijze waarop deze partijen met jouw gegevens omgaan. Kijk daarom of de door jou bezochte site een privacyverklaring bevat. Zo ja, lees deze om te zien of je je kunt vinden in het daarin beschreven privacybeleid van de betreffende partij.

6. Verwerkt Blue Radix ook bijzondere en/of strafrechtelijke (persoons)gegevens?

Bijzondere persoonsgegevens zijn gegevens over gezondheid, gegevens over religieuze of levensbeschouwende overtuigingen, etnische gegevens of gegevens betreffende ras, politieke opvattingen, het lidmaatschap van een vakbond, biometrische gegevens met het oog op de unieke identificatie van een persoon, genetische gegevens en gegevens met betrekking tot iemands seksueel gedrag of seksuele gerichtheid. Blue Radix verwerkt géén bijzondere persoonsgegevens, tenzij dat door de wet is toegestaan. Vraag je ons om bijzondere persoonsgegevens over je vast te leggen of maak je deze gegevens zelf openbaar? Dan verwerken wij deze gegevens alleen als dit noodzakelijk is voor onze dienstverlening.

Een andere categorie gegevens betreft de strafrechtelijke gegevens. Het gaat daarbij om de verwerking van persoonsgegevens betreffende strafrechtelijke veroordelingen en strafbare feiten of daarmee verband houdende veiligheidsmaatregelen. Ook gaat het om persoonsgegevens betreffende een door de rechter opgelegd verbod naar aanleiding van onrechtmatig of hinderlijk gedrag. Deze gegevens kan Blue Radix ook verwerken als de wet dat toelaat of in het kader van onderzoek naar strafbare feiten of bij hinderlijk en/of (eerder vertoond) agressief gedrag.

7. Aan wie verstrekt Blue Radix mijn (persoons)gegevens?

Blue Radix kan je persoonsgegevens en vertrouwelijke informatie verstrekken aan dienstverleners, die wij inschakelen bij onze bedrijfsvoering of voor de uitvoering van onze diensten en die daarbij in onze opdracht deze gegevens verwerken. Blue Radix kan bijvoorbeeld dienstverleners inschakelen voor IT-ondersteuning. Blue Radix verstrekt aan dienstverleners uitsluitend gegevens die noodzakelijk zijn voor de dienstverlening. Blue Radix verplicht de dienstverleners met wie Blue Radix persoonsgegevens en vertrouwelijke informatie deelt deze uitsluitend te gebruiken in het kader van de betreffende dienstverlening aan Blue Radix of om aan wettelijke verplichtingen te voldoen. De dienstverleners mogen ook uitsluitend op instructie van Blue Radix handelen. Blue Radix verplicht deze dienstverleners de gegevens afdoende technisch en organisatorisch te beveiligen en geheim te houden.

Het uitgangspunt van Blue Radix is om dienstverleners in te schakelen in landen binnen de EER waar een passend beschermingsniveau geldt. Het is echter mogelijk dat Blue Radix dienstverleners inschakelt over de hele wereld gevestigd zijn. Dit kan daarom doorgifte meebrengen aan derden in landen die niet hetzelfde beschermingsniveau van persoonsgegevens kennen als Nederland. Blue Radix doet dit echter alleen indien door deze derden een passend beschermingsniveau kan worden geboden overeenkomstig de voorschriften van de Nederlandse toezichthouder de Autoriteit Persoonsgegevens (“AP”). Je persoonsgegevens kunnen zowel tijdens als na de verwerking voorwerp zijn van onderzoek door bevoegde nationale autoriteiten van de landen waar dergelijke gegevens zich vanwege het verwerkingsproces bevinden.

Daarnaast kan Blue Radix (wettelijk) worden verplicht om je persoonsgegevens en vertrouwelijke informatie te verstrekken aan overheidsinstanties, toezichthouders, politie of bijvoorbeeld aan professionele raadgevers (zoals een bewindvoerder of advocaat). Indien dit het geval is zal Blue Radix jou hiervan op de hoogte stellen.

Je persoonsgegevens worden zonder jouw toestemming niet verkocht of verhuurd aan derde partijen die deze vervolgens voor eigen doeleinden verder verwerken.

Vertrouwelijke informatie wordt enkel gepubliceerd nadat we goedkeuring hiervoor van jou hebben ontvangen.

8. Welke regels gelden voor Blue Radix bij de verwerking van (persoons)gegevens?

Bij de verwerking van persoonsgegevens in Nederland is Blue Radix onder meer gebonden aan:

De Algemene Verordening Gegevensbescherming (‘AVG’)
De Telecommunicatiewet

Daarnaast ondersteunen wij het G4 Dataprotocol van Glas 4.0 en leven wij deze na.

9. Wat zijn mijn rechten?

Je hebt een aantal rechten met betrekking tot de persoonsgegevens die Blue Radix van je heeft gekregen. Deze rechten worden hieronder uitgelegd. Rechten zijn niet absoluut, er zijn altijd uitzonderingen mogelijk waardoor we geen gehoor aan je verzoek kunnen geven. Als dat zo is dan leggen we dat aan je uit.

Als je Blue Radix een verzoek stuurt over één van deze rechten, zal Blue Radix hier binnen vier weken op reageren. Je kunt je verzoek doen per e-mail aan info@blue-radix.com onder vermelding van ‘Privacy’. In het verzoek moet je zoveel mogelijk specificeren op welke persoonsgegevens je verzoek betrekking heeft. Ook moet je je verzoek voorzien van je naam, adres en telefoonnummer. Het doen van een verzoek is kosteloos, tenzij je ongegronde of buitensporige verzoeken doet.

Voordat we aan je verzoek kunnen voldoen, zijn we wettelijk verplicht om je te identificeren. Er zijn verschillende opties, bijvoorbeeld het maken van een kopie van jouw identiteitsbewijs zonder de pasfoto en het burgerservicenummer te kopiëren.

Recht op inzage van je persoonsgegevens

Als klant heb je recht op inzage in je persoonsgegevens. Dit houdt in dat je bij Blue Radix kunt opvragen welke persoonsgegevens er van je worden verwerkt en voor welke doelen die gegevens worden gebruikt.

Recht op correctie of verwijdering van je persoonsgegevens

Als klant heb je het recht om je persoonsgegevens te laten verbeteren als deze gegevens onjuist zijn. Je kunt ook een verzoek doen aan Blue Radix om je gegevens te verwijderen. Blue Radix kan hier alleen aan voldoen als zij niet verplicht is om je gegevens te bewaren of als zij de gegevens niet meer nodig heeft om diensten aan je te kunnen leveren. Als de gegevensverwerking gebaseerd is op toestemming, is verwijdering van je gegevens niet in alle gevallen volledig mogelijk. De oorspronkelijke toestemming zullen wij in dat geval moeten bewaren als bewijs dat er ooit toestemming is geweest.

Recht van verzet en recht op beperking van het gebruik

Als klant van Blue Radix heb je wettelijk een aantal mogelijkheden om je te verzetten tegen verder gebruik van je gegevens. Ook als je in een eerder stadium toestemming hebt gegeven, kun je je verzetten tegen verder gebruik van je gegevens of je toestemming intrekken. Je kunt alleen kosteloos bezwaar maken tegen het gebruik van je persoonsgegevens indien je persoonsgegevens worden gebruikt voor andere doelen dan noodzakelijk voor de uitvoering van een overeenkomst of noodzakelijk voor het nakomen van een wettelijke verplichting. Als je denkt dat de verwerking van je gegevens door Blue Radix onrechtmatig is of als Blue Radix je gegevens niet langer nodig heeft, maar je wilt zelf dat deze gegevens niet worden gewist, dan kun je een verzoek tot beperking van de verwerking doen. Je gegevens blijven dan opgeslagen maar worden in principe verder niet gebruikt. Het verzoek tot beperking kan ook worden gedaan als je nog wacht op een controle van je gegevens of op een antwoord op je verzet tegen het gebruik.

Recht op gegevensoverdraagbaarheid (ook wel het recht op dataportabiliteit genoemd)

Je kunt Blue Radix een verzoek doen om de gegevens die Blue Radix van jou heeft ook zelf (elektronisch) te verkrijgen of Blue Radix als verantwoordelijke te verzoeken deze over te dragen aan een andere verantwoordelijke.

Het recht op gegevensoverdraagbaarheid geldt alleen voor persoonsgegevens die zijn verzameld op basis van toestemming of op basis van een overeenkomst.

Daarnaast mag het alleen gaan om persoonsgegevens welke zijn verstrekt door, en gerelateerd aan, jou. Hieronder worden zowel persoonsgegevens die actief en bewust door jou zijn verstrekt (zoals je e-mailadres bij het aangaan van je overeenkomst met Blue Radix), als persoonsgegevens die zijn verstrekt door middel van het gebruik van een dienst (bijvoorbeeld via cookies verzamelde gegevens over jouw zoekgeschiedenis) verstaan. Naast persoonsgegevens van jezelf, vallen hieronder ook gepseudonimiseerde gegevens en gegevens van derden die aan jou zijn gerelateerd. Afgeleide gegevens (bijvoorbeeld een interesseprofiel opgebouwd door bezoekersgedrag te registreren) vallen uitdrukkelijk niet onder gerelateerde gegevens.

Recht van verzet tegen profilering

Profilering is elke vorm van geautomatiseerde verwerking van persoonsgegevens, waarbij aan de hand van persoonsgegevens bepaalde persoonlijke aspecten van jou worden geëvalueerd. De bedoeling hiervan is om bijvoorbeeld persoonlijke voorkeuren, interesses en bezoekersgedrag te analyseren of te voorspellen.

Bij Blue Radix vindt geen geautomatiseerde besluitvorming op basis van profilering plaats, als daaraan rechtsgevolgen voor jou zijn verbonden of het besluit jou in aanmerkelijke mate treft, tenzij dit:

noodzakelijk is voor het aangaan of uitvoeren van een overeenkomst met jou;
op grond van de Nederlandse wet is toegestaan (bijvoorbeeld opsporing van belastingfraude); of
berust op jouw uitdrukkelijke toestemming.

Als geautomatiseerde besluitvorming op grond van één van bovenstaande gronden plaatsvindt, zullen wij je hierover specifiek informeren. Je hebt het recht op menselijke tussenkomst, maar ook om je standpunt toe te lichten en het besluit aan te vechten. Daarnaast heb je het recht om ons om uitleg te vragen over de totstandkoming van het besluit.

Je kunt ook bezwaar maken tegen het gebruik van je persoonsgegevens voor profilering. Als je specifiek bezwaar maakt tegen het gebruik van je persoonsgegevens voor profilering met betrekking tot direct marketing, dan zal Blue Radix jouw persoonsgegevens hoe dan ook niet meer voor zulke doeleinden gebruiken.

10. Zijn mijn (persoons)gegevens (be)veilig(d) bij Blue Radix?

Je persoonsgegevens worden zorgvuldig bewaard en niet langer dan noodzakelijk is voor het doel waarvoor zij zijn verwerkt. Binnen Blue Radix kunnen je persoonsgegevens alleen worden gebruikt door medewerkers die hier, gelet op hun functie, toegang toe moeten hebben. Onze medewerkers hebben een geheimhoudingsplicht. Willen wij gegevens voor een ander doel gebruiken dan waarvoor ze oorspronkelijk verwerkt waren? Dan kunnen wij dat alleen wanneer er tussen beide doelen een nauwe verwantschap bestaat.

Blue Radix neemt passende technische en organisatorische maatregelen om je persoonsgegevens te beveiligen tegen vernietiging (per ongeluk of onrechtmatig), verlies, misbruik, vervalsing, ongeoorloofde toegang of verspreiding of enige andere vorm van onrechtmatige verwerking van je persoonsgegevens. 11. Waar kan ik een datalek melden?

Blue Radix vindt het heel belangrijk dat de gegevens veilig zijn. Mocht het zo zijn dat gegevens bijvoorbeeld zijn kwijtgeraakt of toegankelijk zijn waar dit niet zou moeten, wil je ons dan zo snel mogelijk informeren? 12. Waar kan ik terecht met een vraag of klacht?

Puede presentar una solicitud a Blue Radix para obtener los datos que Blue Radix tenga de usted (electrónicamente) o solicitar a Blue Radix, como controlador, que los transfiera a otro controlador.

El derecho a la transferibilidad de datos solo se aplica a datos personales recopilados con base en el consentimiento o con base en un contrato.

Además, solamente puede abarcar a los datos personales proporcionados por usted y relacionados con usted. 10. ¿Mis datos personales y confidenciales están seguros en Blue Radix?

Sus datos personales e información confidencial se almacenan cuidadosamente y no más de lo necesario para los propósitos para los cuales fueron procesados. En Blue Radix, sus datos personales solamente pueden ser utilizados por empleados quienes, dado su cargo, deben acceder a ellos. Appendix 3. Confidential information

La información confidencial incluye, pero no se limita a:

b) Información protegida, datos, datos, fórmulas, procesos y procesos técnicos, prácticas, técnicas, ideas, métodos, modelos, planes, estrategias, diseños, fotografías, planos, especificaciones, software, invenciones, patentes, descubrimientos, tecnología, información de configuración de hardware, muestras, investigación, investigación y desarrollo, literatura técnica y datos u otro material que es atribuible a o que surja de discusiones sobre las actividades de su empresa;

g) Notas, extractos, análisis o materiales proporcionados por o en nombre de Blue Radix B.V., ya sean de sus Empresas Filiales, que hayan sido fabricados y copiados o derivados de Información Confidencial, claramente marcada como “confidencial” o que dice ser confidencial;
